The law concerning business leaseholds / leases on real estate property, applies to property used for purposes other than, and excluding, domestic use. Often the rules will also be applied to contracts designated as "leasing", "franchise" or "leasehold".
The Act on Business Leaseholds / leases (Erhvervslejeloven) includes, amongst other things, complex sets of rules in that govern lease regulations, conveyancing, business protection and termination of leases. Business lease agreements are, therefore, usually rather complicated. This area of law is generally regarded as one which demands painstaking and undue attention to detail when formulating provisions and drawing up contracts in such areas as lease regulation, right of assignment, subletting, distribution of operating costs of the property, insurance conditions, maintenance, moving, and renovation.
Kirk Larsen & Ascanius is highly experienced both in formulating lease agreements so as not to infringe lease regulations, and in dealing with other legal lease disputes and negotiating settlement.
