House purchase counselling

The counselling at Kirk Larsen & Ascanius in connection with buying of a house aims at giving the buyer un-biased counselling securing that negotiations and completion of the property trade progresses without any problems. In connection with buying of a house, e.g. a detached house, owner-occupied flat, co-housing flat or other types of accommodation as well as buying of a holiday home, we advice within the following subjects.
Before the purchase:
  • Personal finance such as preparation of budget, or going through already prepared budgets.  
  • Family and succession legal matters; for example questions concerning the procedure relating to unmarried couples living together purchasing real property.
  • Taxation relations, especially including questions concerning owner shares in connection with the regulations on deduction.
  • The price formation on the property market in general, including factors affecting the formation of prices.
 During the purchase negotiations:
  • Negotiation of the conditions of buying, such as the direct contact with the estate agent in connection with price negotiation, special conditions etc.  
  • The financial conditions, including conditions, which can affect the pricing of the property in question.
  • Financing of the property, including going through the estate agent’s and others’ financial suggestions as well as counselling concerning different ways of mortgaging.
  • The legal conditions, including the legislation of building and planning etc.
  • Insurance conditions, including the need for insertion of special terms relating to taking out insurance.  
  • The structural survey and the offer of a home warranty insurance, especially including the importance of buyer’s legal position in relation to seller’s exemption of liability.
  • Constructional counselling, i.e. whether it is necessary to have an independent evaluation of the property made by a construction specialist engaged by the buyer.
  • Right of cancellation, including the importance of reservations for the lawyer’s approval.  
  • Foreign currency hedging, i.e. counselling on the meaning of foreign currency hedging or immediate taking out a mortgage loan.
 After the purchase:
  • Title confirmation, i.e. drawing up the title deed and digital registration here of.  
  • Assumption of existing mortgage debt, draw up and confirmation.
  • Completion statement, draw up and dispatch.
  • The trade is finished by a transcript of the digitally registered title deed without annotations and release of deposited amount.
