Real property in foreign countries

Kirk Larsen & Ascanius assists both investors as well as private persons in connection with buying of real property in a foreign country. We have established a network of foreign partners, who can be involved if necessary.

Investor counselling As investor it is important to make certain that the contractual foundation is correct when it comes to investment in real property in a foreign country. It is crucial to be familiar with the regulation and rules of the country in question as well as the procedures and practices, which are used in these countries. We assist in counselling and securing of the rights of investors, if necessary together with our partners in the respective countries. The counselling can furthermore include exposure of the fiscal relations in connection with the investment.

Private investment
Security The case of security in foreign countries is very different from security in Denmark. An actual security, as we know it in Denmark, therefore depends upon the fact that it is included as a term in the negotiations in relation to the purchase of the owner-occupied house.
 
Purchase procedure
The purchase procedure varies from country to country. It is important to be aware of the development of the case right from the very beginning starting with the initial contact with the estate agent/contractor to applications concerning permissions, disbursing of instalments and securing that the title to the property is transferred.

Co-habitation agreements If an owner-occupied house is jointly bought by more parties, the interrelationship can be controlled by means of a co-habitation agreement, which among other things takes the following into account:
  • Disposal of the property
  • How to relate to the fact that a party wishes to sell his share of the property
  • Distribution of profit/deficit by sale, should there during the purchase have been paid different contributions. 
  • How to relate to a situation where one party does not fulfil his part of the agreement.
